The Environmental Protection Act (1990) imposes a Duty of Care on the handling of Resource, which affects anyone who:
- Produces
- Imports
- Stores
- Transports
- Treats
- Recycles or
- Disposes of controlled Resource
The primary onus of responsibility for the handling of Resource is on the Resource producer, who must ensure that Resources are stored securely and that they are transferred to an "authorised" person only.
Any Resource transfer must be accompanied by a written Resource transfer note (WTN) in which the Resource is sufficiently and accurately described. You can use individual WTN's for each transfer, or can use a "season ticket" to cover repeated transfers of the same type of Resource to the same handler. You must keep WTN's for at least two years.
